Trade Marks Registry Announces Special Disposal Drive for Pending Opposition Matters
The Trade Marks Registry (CGPDTM) has announced a Special Disposal Drive for pending Trade Mark Opposition matters where parties wish to withdraw the application/opposition or have reached an amicable settlement.
📅 Period: 4 September 2026 to December 2026
📌 Every working Friday
💻 Hybrid Mode – Physical + Virtual
📅 Year-wise Schedule
🔹 September 2026: Applications filed before 2000
🔹 October 2026: Applications filed from 2001–2010
🔹 November 2026: Applications filed from 2011–2020
🔹 December 2026: Applications filed from 2021 onwards
📄 What parties need to do?
Applicants/Opponents or their authorised representatives should submit the relevant Settlement Deed or Withdrawal Request at least 3 days before the scheduled hearing.
⚠️ Important: Non-appearance or non-compliance may result in the matter being dealt with ex parte or on merits, based on the available record.
💡 Practical Takeaway
Businesses with old or long-pending trademark oppositions should immediately review their IP portfolios.
If a dispute has already been commercially settled—or the opposition is no longer required—this Special Disposal Drive may provide an opportunity to bring the pending proceeding to an appropriate conclusion.
Applicable provisions:
📍 Section 21, Trade Marks Act, 1999
📍 Rules 42–51, Trade Marks Rules, 2017
